Terms of Service

These Terms of Service (“Terms”) govern your use of the Tryst platform, operated by Tryst (“we”, “us”, “our”) at trystplatform.com. By creating an account or making a booking through Tryst, you agree to these Terms. If you do not agree, do not use the platform.

These Terms are provided as a working document and should be reviewed by a qualified solicitor before relying on them for commercial purposes.

1. Definitions

Platform
The Tryst website, web application, and associated APIs at trystplatform.com.
Salon Owner
A business customer who subscribes to Tryst to manage their salon, staff, and client bookings.
Technician / Renter
An independent professional who rents a space or chair within a Salon Owner’s premises and receives bookings through Tryst.
Client
A consumer who books an appointment through the Platform.
Services
The software-as-a-service products provided by Tryst, including booking management, diary, payments, and client communication tools.

2. The Services

Tryst provides salon management software on a subscription basis. The Platform facilitates bookings between Clients and Salon Owners or Technicians. Tryst is a technology intermediary — we are not a party to the appointment contract between a Client and a Salon Owner or Technician, and we are not responsible for the delivery of hair, beauty, or other treatments.

We reserve the right to update, modify, or discontinue any feature of the Platform with reasonable notice. Where changes materially affect your use of the Platform, we will notify Salon Owners by email at least 14 days in advance.

3. Salon Owner Accounts

To use the Platform as a Salon Owner you must: be at least 18 years old; be a legally registered business or sole trader; provide accurate information during registration; and keep your account credentials secure.

You are responsible for all activity that occurs under your account. You must notify us immediately at hello@trystplatform.com if you believe your account has been compromised.

You are responsible for ensuring that any Technicians or staff you add to the Platform comply with these Terms. Your client data remains yours — Tryst does not sell or share it with third parties except as required to deliver the Services (see our Privacy Policy).

4. Subscription and Billing

Access to the Platform requires an active paid subscription. Subscription plans, pricing, and any free trial terms are set out at trystplatform.com/pricing and may be updated from time to time.

Subscriptions are billed in advance on a monthly or annual basis. Payments are processed by Stripe. By subscribing you authorise us to charge your payment method on the renewal date.

You may cancel your subscription at any time from your billing settings. Cancellation takes effect at the end of the current billing period — there are no partial refunds for unused time unless required by applicable law.

We reserve the right to suspend or terminate accounts that are in arrears after reasonable notice.

5. Client Booking Terms

When a Client books an appointment through the Platform, a contract is formed between the Client and the relevant Salon Owner or Technician. Tryst facilitates the booking and payment but is not a party to that contract.

Clients must provide accurate contact information when booking. Bookings are subject to availability and are confirmed only upon receipt of any required deposit.

Tryst may send Clients transactional emails relating to their booking (confirmation, reminders, receipts, cancellation notices). Marketing communications are only sent where the Client has given explicit consent.

6. Deposits

Some bookings require a deposit at the time of booking. The deposit amount is set by the Salon Owner and is displayed clearly before checkout. The deposit is applied against the total appointment cost on the day.

If you cancel within the free cancellation window (typically 48 hours before your appointment — the exact window is shown during booking), your deposit will be refunded in full to your original payment method within 5–10 business days.

If you cancel inside the free cancellation window, or do not attend your appointment, the deposit is non-refundable and may be retained by the Salon Owner or Technician as a cancellation or no-show fee.

7. Cancellation and No-Show Policy

Clients may cancel an appointment online via their booking confirmation link up until the free cancellation window closes (typically 48 hours before the appointment start time). After this point, online cancellation is disabled and you must contact the salon directly.

Salon Owners may configure a no-show fee for clients who do not attend a confirmed appointment without cancelling. Where a no-show fee applies, this will be charged to the payment method used at booking. No-show fees are disclosed at the time of booking.

Salon Owners reserve the right to cancel or reschedule appointments in exceptional circumstances (illness, emergency, unforeseen closure). In such cases, any deposit paid will be refunded in full.

8. Payments

Payment processing is provided by Stripe. By making a payment through the Platform you agree to Stripe’s Terms of Service.

Tryst charges a platform booking fee per confirmed appointment to cover payment processing costs. This fee is displayed during checkout and is non-refundable except where required by applicable law or where a booking is cancelled by the Salon Owner.

Funds collected on behalf of Technicians are held by Stripe and transferred according to the payout schedule agreed between the Salon Owner and Tryst. Tryst does not hold client funds on its own account.

9. Acceptable Use

You must not use the Platform to:

  • Provide false or misleading information
  • Engage in fraudulent bookings or payments
  • Harass, abuse, or threaten other users
  • Attempt to access accounts or data you are not authorised to access
  • Reverse-engineer, scrape, or copy the Platform or its data
  • Use the Platform for any unlawful purpose

We reserve the right to suspend or terminate any account that violates these rules without notice.

10. Intellectual Property

The Platform, its design, software, trademarks, and content are owned by Tryst or our licensors. These Terms do not grant you any rights to our intellectual property beyond the limited licence required to use the Platform as intended.

You retain ownership of any content you upload (logos, images, service descriptions). By uploading content you grant Tryst a non-exclusive licence to display it within the Platform for the purpose of delivering the Services.

11. Data Protection

Tryst processes personal data in accordance with UK GDPR and the Data Protection Act 2018. Our Privacy Policy sets out in full what data we collect, why we collect it, how long we retain it, and your rights as a data subject.

Salon Owners act as independent data controllers in respect of their clients’ personal data. Tryst acts as a data processor on behalf of Salon Owners when processing client data to deliver the Services. A Data Processing Agreement is available on request at hello@trystplatform.com.

12. Limitation of Liability

To the fullest extent permitted by law, Tryst’s total liability to you for any claim arising out of or in connection with these Terms or your use of the Platform is limited to the fees you have paid to Tryst in the 12 months preceding the claim.

Tryst is not liable for: any loss of profits, revenue, goodwill, or data; any indirect or consequential loss; missed appointments or service failures by Salon Owners or Technicians; or any third-party services (including Stripe).

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other matter that cannot be excluded by law.

13. Termination

Either party may terminate at any time. Salon Owners may cancel their subscription from the billing settings; Clients may request account deletion by emailing hello@trystplatform.com.

On termination of a Salon Owner account, we will retain your data for 30 days to allow export before deletion, except where we are required by law to retain it longer. You remain responsible for any outstanding payments at the point of termination.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified to Salon Owners by email at least 14 days before they take effect. Continued use of the Platform after that date constitutes acceptance of the updated Terms. Clients will see updated Terms presented at their next booking.

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer protection laws in your country of residence provide otherwise.
